Order fulfillment online

To place an order in www.kicks.pt it is necessary to the "User" to have a valid e-mail account of frequent use and to register as a "KICKS" Customer filling out the available form online. Once registered, just put all the products in the virtual shopping basket that the "Final consumer" proposes to acquire, following every step of the purchase for it to be successfully completed. 


How to order at www.kicks.pt :

- Browse the online page "KICKS" and find the products that you want to buy;

- Add products preferred to the basket through the "ADD TO BASKET" button;

- The moment you understand that you have chosen all the pieces you want to buy , finalize the purchase by clicking the "Checkout" button in the basket icon;

- Then fill in your personal information in a simple form (do take care in filling in the address);

- Select the method of payment;

- Review your order;

- Proceed to the payment confirming the order;

- Finally, you will receive an order confirmation via e-mail;

- Selecting the "Exit" button at the end of the buying process, will confirm your order and you'll just have to wait the predicted days for the postal delivery of parts.


Once you complete your purchase, you will receive an automatic email to confirm the transaction. We suggest for you to print or to download this copy for future reference. If your data is not correct it may ask immediately for changes, or even the cancellation of the purchase.


In case of no confirmation of payment or breach of conditions and General Sales Terms, the "NICE KICKS" reserves the right to not accept your order or cancel it totally or partially, even after automatic confirmation of the same.

 

Product availability and confirmation / order cancellation

"NICE KICKS" only processes an order placed by a customer after its payment is confirmed, so the "NICE KICKS" cannot guarantee the availability of products by the beginning of that process.


In order confirmation you will find the estimated date for shipment of the products, after confirmation of payment: 2-4 days or 1-2 weeks. Of course, the estimated time for delivery may vary depending on the carrier to choose from and the destination of your order.


"NICE KICKS" only makes shipping orders on weekdays. Thus, to estimate the delivery time of orders, weekends or public holidays are not accounted for. Given the estimate of the dates presented, any delay in the shipment of goods does not confer the right to compensation.


The satisfaction of all orders placed on the site is subject to availability of products. The "NICE KICKS" tries to ensure that all items offered for sale on the website are in stock. However, the "NICE KICKS" reserves the right to not accept any orders or cancel orders already confirmed for products that are already out of stock. In case of unavailability of the product and / or stock break, the "NICE KICKS" immediately informs the "Final comsumer" of the partial or complete cancellation of your order, the buyer is entitled to reimbursement of the respective amount paid.

 

Cancellation or confirmation of an order

"NICE KICKS" might not validate the order that does not have sufficient guarantee of good recovery when the order is incomplete or incorrect, or where the products ordered are no longer available. In any of these cases, the "NICE KICKS" will inform via email the "Final consumer" that the sales contract was not carried out and that "NICE KICKS" did not proceed with the sale, specifying the reasons.


If the products ordered in www.kicks.pt are not available at the time of the last access to the site, despite having obtained confirmation of the order, or when the "NICE KICKS" acquires your request, "NICE KICKS" immediately informs the "User" about the unavailability of the same, never exceeding a period of 30 days after receiving your order.


If you have an order made, and respective payment done for products that later became unavailable, "NICE KICKS" proceeds to refund (repayment) the money paid for the unavailable items.


"NICE KICKS" reserves the right to refuse any order for any reason and exempted from liability for any damages or costs, and reserves the right to cancel any purchase even if it has already been accepted or confirmed by "NICE KICKS" in particular in the following situations:

- The information in the invoice is not correct or verifiable;

- The Order is signed by the website Security Systems as improper, irregular or an order susceptible to fraud;

- When the order's payment was not transfered within 5 days of subsequent work days from the order's acceptance;

- When is not possible to deliver the order at the address provided by the "User";

- If we think that the "Purchaser" held no ability to perform that act;

- If it is found that there was an error in reporting the price of the product;

- If we assume that the order comes from a reseller.

 

Payment & Security Guarantees

The available payment methods will be presented in www.kicks.pt. We do not accept any other payment method than the above.  

You can pay for your products using your personal PAYPAL account, MB WAY, credit card or you can pay your order through ATM, and "KICKS" will give you the necessary instructions for this method of payment (entity / reference / Total Value).

The purchase price of the product and shipping costs, as indicated on the order form, will be charged to the current account when the purchased products are actually shipped.


Do not make the payment by any other means not specified in www.kicks.pt. If you try, "NICE KICKS" shall not be liable for the loss of payment or any other damages which may possibly result.


 

Security of the online "NICE KICKS" store and all transactions

The online "NICE KICKS" store uses the latest and robust security technologies available for encryption platforms. All payment information you provide will be encrypted from the initial time of the transaction up to the time the order is processed, and will not be saved in any public server.


Even though we use a very evolved encryption software, any payment transmitted over the Internet, or through e- mail , has some risks in particular when the "User" does not take the proper precautions nor assumes the proper conduct of responsibility.


"NICE KICKS" cannot be charged for any damage suffered resulting from the use of electronic media, that being the damage from failure or delay in delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs virus used for communications or broadcasting.


Property reservation of marketed products

"NICE KICKS" retains ownership of the goods traded until it has received full payment of all these products.


Prices

Prices of products displayed on the website "www.kicks.pt" are subject to Value Added Tax (VAT).


The total price specified at the end of "checkout" menu includes taxes and shipping costs, so you should only transfer the exact amount specified in the order confirmation, and make individual transfers per order. Shipping charges are calculated per order, and the exact price of shipping fee depends on the country where your order will be delivered.


Prices are all broken down into Euros and any change in the order of the delivery country may have an impact on prices, because of transport costs.


Quality

"NICE KICKS" only commercializes in "www.kicks.pt" quality articles and will never sell second-hand products, defective or of any lower quality than existing standards on the market.

Products offered for sale in "www.kicks.pt" may not exactly match the image displayed and colors and may undergo color changes, especially due to the Internet browser and monitor used by the "User".


After-sales service and guarantees

All products sold benefit from a guarantee of conformity, without prejudice to applicable legal guarantees. If the item ordered has any defects the customer must communicate to the "NICE KICKS" by email via info@kicks.pt at a maximum period of 15 days after delivery to be resolved the situation.

The shipping costs will be borne by the customer.

Upon reception of the defective item, "NICE KICKS" will proceed to send the defective item for analysis in the brand and this has a maximum of 30 days to give an answer to "NICE KICKS". regardless the problem of the product, it is necessary to send along with the goods a copy of the invoice.

Please note that the warranty does not apply (or parcially applies) to repair problems resulting from misuse or non-use according to the manufacturer's specifications of use.

If the mark says that the article is defective a credit note will be issued with the same amount spent by the customer, to be exchanged for an equal or higher value product.


The "NICE KICKS" can not be held responsible if the manufacturer refuses to apply the guarantee. Repair budgets not accepted by the customer may be subject to administrative fees. If you agree with the budget, you'll have to make a bank transfer corresponding to the respective repair value.


Right of withdrawal, exchange and Returns Products

The customer benefits from a right of withdrawal of 30 days to return to us a product purchased in the online store, which is not in accordance with the Article 10 of Decree-Law No. 24/2014 of 14 of February. This period shall begin from the date of delivery of the order.


If for some reason you are not satisfied with a product you ordered, you can return it to our services thanks to our guarantee "Satisfied or refunded" and the legislation in force. In case of non-compliance or withdrawal college exercise, you can return the products received, respecting the conditions described below. You will not be able to proceed with a return if there is clear evidence that the products have been used for a prolonged period or for purposes other than those stated. If you want to return the purchased product, do not remove the labels or product security seals acquired and keep the original boxes that they come packaged whole and in good condition.


If you decide to return the purchased products, "NICE KICKS" has the right to not accept product returns if the returned parts do not have the original packaging, the label or corresponding safety seal, or when labels have been changed in relation to its original state or damaged (the products damaged, dirty and showing traces of use will not be accepted).


After receiving the receipt of your order, the "Buyer" has a period of 30 days to return or exchange the article(s) under the conditions indicated above, if we find that they present defects or other non-conformities in relation to the products ordered or simple abandonment, without expressly indicating the justified reason for info@kicks.pt email, the costs of a return or exchange will be borne by the Client.



The exchange or return of orders shall be performed by placing the item(s) you want to return in the original packaging, with its intact price tags and no trace of use, joining invoice order.


Upon receiving the returned products in our facilities, we will proceed to their treatment within an average of one week. In case the return is confirmed, it will be refunded the amount by the same payment method. The value of the sale returns to the account / card that was used for the purchase. In case it is a simple exchange of paper, color or size, then after checked the availability of this product, it is sent to the address specified in the exchange process.

 

Cancellation of Orders

Before shipment, the "Buyer" can cancel the ordered products. If the "User" places an order and wants to cancel it, he must, at first, check the status of your order through the website www.kicks.pt menu. If it was not dispatched yet, then, there is still the possibility of it being canceled. For this, the "User" should contact us through our info@kicks.pt email and request the cancellation of your order.

If the cancellation request is successful, the client will be notified by email of this decision and cancellation will be processed at no cost to the customer.


If the cancellation request is not possible because the order has already been dispatched, the products will be sent to the "Buyer" and, if he still retains the intentions of cancelling the order, he must perform the return mechanisms.


Only upon confirmation of the return, acquiring the order returned by the "NICE KICKS" and having checked the state of the product, it will only be then processed the refund (repayment).


Responsibility

"NICE KICKS" will only be liable for damage sustained by the "Buyer" if such damages result from attributable violations of contractual obligations by "NICE KICKS" to the "Final consumer" or in the case of liability resulting from the applicable legal right.


If the "Buyer" has suffered damage related to the website activity, the responsibility for "NICE KICKS" will be limited to: product damage "NICE KICKS" and reasonable costs and demonstrably incurred by the "Buyer" because of the violation by the "NICE KICKS" Conditions of Sale and General Terms, excluding any other.


"NICE KICKS" shall not be liable for damages suffered by third parties resulting from the use of any of our products. "NICE KICKS" shall not be liable for damage sustained by the "Buyer" as a result of misuse of our products.


"NICE KICKS" is not responsible for damages that may occur due to incorrect information on the website.


All products sold by "NICE KICKS" are in accordance with the Portuguese and Community legislation.


"NICE KICKS" declines any responsibility in case of violation of the country where the order is delivered. It is for the client to check with local authorities the import conditions or use of the products you want to order.

 

Intellectual and Industrial Property

All texts, commentaries, works, illustrations, creations and images reproduced or represented on the www.kicks.pt site are strictly reserved under copyright and intellectual property rights, to the whole world.


Accordingly and in accordance with the Intellectual Property Code, it is only authorized the use of information for private purposes, subject to contrary provisions including more restrictive provisions in the Code.


Any total or partial copy representation of the site www.kicks.pt, in whole or in part, the elements included in it is strictly prohibited.


The company names, trademarks and distinctive signs played on www.kicks.pt site are protected in accordance with the legal provisions applicable to industrial property. Any copy or representation of part or parts of any distinctive signs is strictly prohibited and should be subject to prior written permission of the trademark owner "NICE KICKS".


If the "User" wishes to use information or site materials, he needs to obtain prior written permission and granted by "NICE KICKS".

 

Applicable law

These Conditions and General Terms of Sale and all disputes arising that relate to these general conditions, including its validity, the use of the site www.kicks.pt or purchase of the same shall be governed by Portuguese law.


In the event of a dispute concerning the interpretation or application of the Terms and General Sales Terms, both PARTIES agree to jurisdiction the District of Lisbon, with express renounce to any other. The invalidity or partial unenforceability of any provision of these Terms and Conditions, or the existing of gaps, will not affect the livelihood of the same untainted part.

 

Changing Conditions and Terms Online Store General Sales

"NICE KICKS" has the right to change these Terms and General Terms of Sale at any time. The " Buyer" is subject of the principles and terms in force at the time of your order, unless the law or authority impose any amendment thereto.
